Operating Guidelines

 
 

Application

These guidelines shall apply to all users, the contractors, vessels and persons entering or using or making use of any of the facilities and services provided by Labuan Liberty Port Management Sdn. Bhd. (LLPM) at the New Liberty Wharf (Port Facility). All companies and establishments working or operate in the Port Facility shall have copy and shall adhere to these guidelines.
 

Administrative Working Hours

Monday to Thursday : 0800 – 1200 / 1300 – 1600
Friday : 0800 - 1200 / 1330 - 1600
Sunday and Public Holiday : Closed
 

Operation Hours

"Per day" means from 0800hrs to 0800hrs the following day (e.g. from Monday 8:00am to Tuesday 8:00am). The user may request for a 24-hour operation per day.
 

Permission To Enter Or Leave The Port Storage Area

Any person or vehicle may enter the premises of the Port Facility only upon securing a permit to enter from the management of LLPM; and is permitted to leave the premises only after securing a clearance from LLPM. All persons and vehicles entering the Port Facility do so at their own risk. LLPM shall not be held liable for damage/injury resulting from entering the Port Facility.
 

Check Points

All incoming and outgoing of vehicles/goods in /out the Port Facitity are subject for inspection at the main entrance or checkpoint. Drivers of vehicles carrying goods must secure a clearance of goods from relevant authorities and must leave a copy of such at the checkpoint.
 

Security

Security operation in the Port Facility is maintain by the security personnel twenty-four (24) hours daily. A security personnel on duty has the authority to stop and to carry out visual check on all persons, vehicles and goods transported in and out of the Port Facility.
 

Amendments

LLPM reserves the right, without prior notice to amend the General Information and Guidelines from time to time and such amendments shall have immediate effect upon publication.
 

Condition Of Offer

Engaging or transacting business with LLPM whether by agreement or otherwise, The Terms and Conditions of Business shall constitute a standing of as to the condition upon which LLPM make its services and facilities at the Port Facility.
 

Security Pass System
 
Obligation To Carry Pas
The user are required to comply with the security pass system when entering or leaving the Port Facility through entrance and check point. A laminated pass will be issued to user and must be worn at all times when entering and while inside the premises of the Port Facility which clearly recorded on it Name, identity Card No, Company’s name and passport size photographs.
 
Visitor Pass
TVisitors entering the Port Facility for a short period are required to register in the book at the port main entrance. Visitors passes will be issued and be valid for the time such visitors remain at the Port Facility. Visitors are required to surrender such passes to the security guard on duty at the guard house when leaving the Port Facility.
 
Workers Pass
Temporary passes will be issued to the temporary workers entering the Port Facility. This pass is valid for the duration of the job. The pass is given at the guardhouse upon entering the Port Facility and it must be surrendered when leaving the premises to the security personnel on duty at the main guardhouse. the users who employ such workers will be responsible in securing the workers' pass by providing information about the workers' particulars before such worker can commence working in the Port Facility.
 
Vehicles Pass
All vehicles or equipments entering or leaving the Port Facility are required to comply with the pass system. Such pass will be issued to the LLPM registered vehicles and be valid for one year.
 
Equipments And Labour
LLPM has the sole right to supply of all requirements for labor and handling equipments for the operation at the Port Facility. Under no circumstances other labor and equipments be brought in the Port Facility without prior authorization from LLPM.
 
Permit For Operation
All users engaged in performing work at the Port Facility shall register their organization and operational vehicles and equipments. To permit such vehicles and equipments to operate in the Port Facility will be the discretion of LLPM.
 
Supervision
All operation in relation to receiving and delivering of import / export cargo and containers at the Port Facility shall be under the directive and supervision of LLPM.
 
Import and Export Cargoes/Containers
 
Cargo (Goods)
Cargo includes livestock, minerals, ware, vehicle and merchandise of every description whether containerized or otherwise.
 
Notice Of Depositing Cargo
Goods shall not be deposited anywhere within the Port Facility without the written notice to LLPM. The user, master or agent of vessel carrying cargo or containers shall give written notice to LLPM of his intention to discharge or load goods for shipment before such work is commenced. LLPM shall not provide any service or accommodation for such goods or containers unless such user, master or agent of vessel make a request or notice for the same, where such request or notice is made, LLPM may where it deem fit to do so in the interest of LLPM refuse the request without assigning any reason therefore.
 
Cargo Without Notice
LLPM shall not be held liable for any delay, loss or damage to cargoes deposited into the port area without proper documentation or permission from the LLPM.
 
Receiving Of General Cargo
LLPM provides tallyman to record the number of packages received into the designated transit area; examine the condition of goods before such cargo is brought into the warehouse for storage. Packages for which bad order receipt has been or found damaged shall be examined and the extent of the damage recorded in the presence of the consignees or vessel or their agents.
 
Damaged Cargo
A joint inspection by representatives of the vessel, consignees and LLPM of all damaged packages is to be carried out. On completion of the joint inspection, it is the responsibility of the consignees or its agents to re-packed, re-bagged or otherwise repair the package to a reasonably sound condition.
 
Delivery Of General Cargo
A delivery of imported goods to consignees or shipper’s goods for shipment from the port area shall not be acted upon until such order in writing together with inward or outward manifest has been received from the vessel or agents. No goods from the Port Facility to be delivered to any consignees failing to produce custom declaration on goods except in the cases for which correspondence has taken place between LLPM and the Custom Authority. LLPM may refuse any delivery or containers to consignees until final completion of discharge of the vessel.
 
Custom Samples
Permission to owner to open packages or containers within the port premises are subjected to Custom Examination requirement shall be advised to LLPM in the prescribed form. Any content taken for samples shall be declared to LLPM clear notification will be endorsed on the packages with the number of samples taken. In the case of containers, the door of container must be closed and pad-locked after completion of custom examination. LLPM shall not be held liable for shortages of content for packages where samples were taken without their declaration delivered.
 
Dangerous Cargo
Dangerous Cargo includes ammunitions, explosives, petroleum or other inflammable materials, noxious or dangerous substances or articles; such cargoes are unacceptable for storage.
 
Rate and Chargers
 
Responsibility Of Charges
Unless otherwise specified or previously agreed upon, responsibility for all charges will be stated in the Schedule of Rates and Charges.
 
Free Storage
The storage period for import or export cargo shall be counted from the time of receipt of the cargo until the time of delivery or shipment. A free 3-days storage period (inclusive of Sundays and holidays) is granted to all consigned goods.
 
Chargeable Tonnage
Charges are based on metric unit one tone or one cubic meter, whichever is the greater. LLPM may elect to calculate all tonnages of cargo according to the cubic measurement or gross weight whichever is the greater whether or not a ship’s manifest is lodged.
 
Weighing
In case details of weight or measurement are missing or give rise to doubt, LLPM may have the goods weighed and/or measured and if the measurement is not mentioned in the manifest except the weight which results in impossibility to determine the measurements it shall be considered as tribal of weight.
 
Payment of Charges
All charges shall be payable in cash and cheques shall not be accepted in any payment except by special arrangement has been made with LLPM.
 
Settlement of Account
Where credit facilities are made available to the user, account in respect of such facilities shall be settled within a period of 30 days from the date of invoice or work commenced. Account which are not settled within the period of 30 days shall be subject to a surcharge of 10% thereof and any account which is not settled within a subsequent period of 30 days shall be subject to a further surcharge of 10%.
 
Undercharges
LLPM shall be entitled to collect any amount which may be ascertained to have been undercharge or that which may otherwise have been found to be due.
 
Removal Charges
Import or export cargo not delivered after the expiry of the free storage, LLPM may remove such cargo if consider necessary for the convenience and appropriate removal charges shall be imposed.
 
Charges For Other Services
Charges for any other services not provided for in the Schedule of Rate and Charges will be quoted on application to LLPM.
 
Handling Outside Normal Working Hours
 
Application
An application shall be made in writing for handling services outside normal working hours to LLPM management office two (2) hours before the intended service/operation starts, and not later than 1500hrs of the previous day if work is to be done on a Sunday or public holiday.
 
Cancellation Charges
If the approved application is subsequently cancelled in whole or in part, a minimum charge equivalent to two (2) hours shall be imposed or whichever is higher.
 
Who To Apply
A vessel discharged goods/containers onto storage area will only be applied by the vessel or its agent only. A consignee who taken delivery of goods/container.
 
Road Traffic In The Port Of Storage Area
 
Driving License
No person may drive any forklift, truck, crane and other handling machinery inside the port area unless he holds a valid driving license or operate such issued under the applicable traffic laws.
 
Vehicle License
No motor vehicle or machinery requiring a license under the traffic laws in operation shall be permitted on the storage area without a valid license.
 
Conditions Of Vehicles and Equipments
  • All transport vehicles must be roadworthy, safe and clean condition in accordance with the road traffic and port safety regulations.
  • All vehicle, machines, cranes and forklifts and other powered equipment must be maintained regularly and each must have a maintenance logbook to ensure excellent condition and be safe for use.
  • All transport vehicle, cranes and forklift and powered equipments shall have maximum axle loads and payloads displayed.
Traffic Signs and Barriers
  • All users are required to observe all safety directions and various signs put forward from time to time and barriers placed at the storage area must not be breached.
  • LLPM shall not be held liable for any injury, loss or damage to persons and/or vehicles resulting from or caused by the erecting or placing of any such barrier or traffic sign or caused by the negligence of any of its officer, servant or agent.
Traffic Behavior
  • Drivers or person in charge of any road vehicle or any type of port machinery or equipments and pedestrians shall at all time while in or entering or leaving the port area conduct himself in an orderly manner, and shall comply with such orders issued and observe any notice or sign exhibited by LLPM or the relevant authority.
  • No person may drive any road vehicle or any type of mechanically powered vehicle or equipments in a dangerous or reckless manner within the port area.
  • Forklift or any other open vehicle shall not to be used to transport the workers within the storage area.
  • Vehicle shall not to be used to transport goods if they are unsafe, the tires are worn out, insufficient lights or vehicle are not provided by sides, fastenings or pillars to avoid falling the goods.
Speed Limits
The speed limit for vehicles operating within the storage area is 20km per hour.
 
Driving Of Vehicle Into Sheds
No vehicle is allowed to be drive into a shed or inside the warehouse without the permission of LLPM.
 
Parking
No vehicle, machinery or other mobile equipments is allowed to park on the road or in an unsafe position or in a manner which may cause danger, obstructions or undue inconvenience to other users, nor be left unattended unless it is within authorized parking area. Vehicle, equipments and machinery must not be parked within the special restricted area of fire hydrants.
 
Parking Areas
LLPM may designate any part of the port area as a parking space but the exercise under this regulation does not render LLPM subject to any liability in respect of loss of or damage to any vehicle and/or the fitting and contents of any vehicle in such parking space.
 
Safety Operation
 
Safety Precautions
LLPM shall from time to time take all reasonable precautions to a better control of a safe and healthy working environment to ensure that business are conducted in a responsible manner. All users are required to observe all safety directions and various signs or instructions put forward by LLPM.
 
Restriction On And Securing Of Loads
  • LLPM may required limitation of a load carried on any vehicle, or any towed trailer, if the load is, or is liable to become a danger or obstruction or inconvenience to persons and vehicles using the port access road.
  • No vehicle or trailer shall carry a load with dimensions in excess of the limitations imposed by the Government Traffic Regulations, except when an exemption permit has been obtained from the Traffic Department.
  • Load projecting beyond the overall dimensions of the vehicle or trailer shall be marked where they protrude with a red marker or with a red and with lights at night.
  • No vehicle shall be loaded with a weight greater than the rated weight capacity as specified by the manufacturer or in excess of limits imposed by Government Traffic Regulations.
  • All loads shall be properly stacked and secured to the satisfaction of LLPM’s safety officer before vehicles are allowed to proceed through the storage area.
  • The owner or hirer of a vehicle shall be held responsible for any loss of life, limp or property or damage arising from improper securing of cargo on his vehicle.
  • Upon entering the storage area, the vehicle carrying hazardous substances shall oblige the relevant regulation stipulated in Part III of Terms and Conditions of Business.
Transport of Containers
No vehicle or trailer shall transport any container within the storage area unless the container is properly secured twist locks, designed to transport containers by land.
 
Refueling Of Vehicles
  • Transport vehicles shall not be refueled inside the port area. It is allowed when safety equipment is available in the location and smoking is prohibited during refueling.
  • Gasoline tanks shall not be filled while the engine is running. Only purpose designed refueling equipment is to be used.
Removal Of Goods Falling From Vehicles
When some cargo of a vehicle fall down on a road of the storage area, the vehicle driver shall maintain the safety of others in the area by removing and reloading the spillage, otherwise LLPM will remove it at the expense of the owner of the vehicle.
 
Reporting Of Accidents
All drivers of vehicles involved in an accident at the storage area whereby a person is injured or properties are damaged shall stop their vehicle and report the matter to LLPM and/or the concerned authorities immediately.
 
Safety and Good Order
 
Pilferage And Smuggling
Attention is drawn to the fact that under the valid laws offences such as pilferage and smuggling are very severely punished and therefore all companies and parties operating in the port storage area must warn all their employees accordingly.
 
Trading In The Storage Area
No person may, except with the written consent of LLPM engage in trading, auctioning or hawking within the port area.
 
Advertising
No person may without having been authorized previously by LLPM, advertise or cause any advertisement to be exhibited on any premises or property of the Port Facility.
 
Prevention Of Damage To Port Property
A plank made of wood or similar material shall be placed under the support legs of mobile cranes during operation to prevent damage to the asphalt surface of the container yard. Drivers handling containers must always keep a safe distance from the fence of the container yard.
 
Crane Lifting Capacity
No crane or lifting device shall be used to lift more than its certified lifting capacity and two cranes shall not be hooked onto one lift without special permission of LLPM. The support legs of mobiles cranes shall be at least 0.5 meters from the quay-side for lifts up to 20 tones and a minimum of 1.0 meters from the quay-side for lifts in excess of 20 tones.
 
Lifting Of Persons
On The Hook No one shall be permitted to ride the cargo hook or gear. Exemption may be made where approved special gear is provided for hoisting or lowering persons or for effecting repairs and maintenance in case of emergency.
 
Repair Of Engines
Repairs to any engines of vehicle, equipment, machinery or other repairs within the storage area shall not be carried out unless approval in writing has first been obtained from LLPM. The user shall be responsible for damage done and loss suffered as a result of such repair activities. Obligation To Keep The Storage Area Clean User or agents responsible for producing garbage of any kind such as broken pallets, cases, boxes, cartons, any wrapping, strapping or other litter produced by careless removal of goods from pre-palletized cargo or by other operations must immediately remove same. LLPM is entitled to undertake the removal of such garbage at the expense of the offender.
